Terms of Service

Welcome to Niju. These Terms of Service ("Terms") govern your access to and use of our web platform (niju.dev) and any related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms.

The Service is operated by Coffee Tap Studio SRL ("we", "us", "our"), a company registered in Romania with company number 49753478.


1. Overview and Nature of the Service

Niju provides a platform for companies to screen engineering candidates. The Service allows a Company to send a 20-minute, fixed-time coding challenge to a Candidate.

During the session, the Service records the Candidate's webcam, audio, screen, and all code written in the Niju editor ("Candidate Data"). We then use AI to process this data, generating a transcript and an assistive analysis ("AI Report").

This full report (including the recording and AI Report) is provided to the Company to assist in their hiring decision.


2. AI-Assisted Service - No Automated Decisions

You acknowledge that Niju's AI-generated reports, transcripts, and analysis are assistive tools only. They are provided to help the Company review the session more efficiently.

  • Niju does not make any automated hiring decisions, pass/fail judgments, or evaluations.
  • The AI opinion is hidden by default to prevent bias.
  • The final decision and all judgments about a Candidate's suitability rest solely with the Company.

3. User Accounts (Companies)

To use the Service as a Company, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities.

Candidates do not create accounts; they access the Service via a unique link provided by a Company.


4. Payments, Purchases, and Refunds (Companies)

4.1. Purchasing Interviews The Service for Companies is offered on a pay-as-you-go basis. You may purchase "interviews" in various quantities, up to a maximum of 50 interviews per single transaction, at the prices listed on our website. Once purchased, these interviews are added to your account balance and can be used to schedule and initiate screening sessions with Candidates.

4.2. Pricing, Taxes, and Currency Prices listed on our website are in USD and are exclusive of any applicable local taxes (such as VAT or sales tax). The final price, including all taxes, will be calculated and displayed on the checkout page before you complete your purchase. Our payment processor may offer the option to pay in your local currency, if available.

4.3. No Expiration Purchased interviews do not expire. They will remain in your account until they are used.

4.4. Payment Processing All payments are processed by our Merchant of Record, Dodopayments. We do not collect, store, or process your payment card information. By making a purchase, you are entering into an agreement with Dodopayments, and their terms and privacy policy will apply to the payment transaction.

4.5. Refund Policy All purchases are final and non-refundable.

4.6. Disputes Should you have an issue with a purchase or a billing discrepancy, you agree to contact us first to resolve the matter. Before initiating a chargeback or dispute with your bank or payment provider, you must email us at support@niju.dev. We will review your request and provide a response within 14 calendar days.


5. Data, Content, and Roles

This section defines the roles and data responsibilities for our two user types.

5.1. Company (Data Controller) As a Company, you are the Data Controller for all Candidate Data you process using the Service. You represent and warrant that:

  • You have a lawful basis (e.g., legitimate interest, candidate consent) to collect and process this sensitive data (video, audio, screen recording) for recruitment purposes.
  • You will comply with all applicable data protection laws (including GDPR).
  • You will use the Niju Service as one part of a fair, non-discriminatory, and comprehensive hiring process, and you remain solely responsible for your hiring decisions.

5.2. Candidate (Data Subject) As a Candidate, you are using the Service at the invitation of a Company. That Company is the Data Controller of your personal data. Niju is acting as a Data Processor on their behalf. For any questions about your data rights (e.g., access or deletion), please contact the Company that invited you.

5.3. CANDIDATE CONSENT TO RECORDING By starting a Niju interview, you, the Candidate, explicitly consent to:

  • The recording of your video (webcam), audio (microphone), and computer screen for the duration of the 20-minute session.
  • The collection of all code you write within the Niju editor.
  • The collection of your IP address and user-agent data for security and platform integrity.
  • The processing of this data by AI to generate a transcript and an assistive analysis.

You understand that this entire package of data (Candidate Data and the AI Report) will be shared with the Company that invited you for their recruitment and evaluation purposes.

If you do not consent to this recording and processing, do not start the interview.

5.4. Data Processing Agreement (DPA) By using the Service as a Company to process Candidate Data, you agree to the terms of our Data Processing Agreement (DPA), which is incorporated by reference into these Terms and available on our website.


6. Third-Party Services and AI Platforms

To provide the full functionality of our Service, Niju utilizes third-party artificial intelligence (AI) platforms and services, such as Large Language Models (LLMs), for transcription and analysis.

By using the Service (as a Company or Candidate), you acknowledge and agree that Candidate Data (such as audio, code, and transcripts) may be sent to and processed by these third-party services. We select our partners (sub-processors) carefully and have data processing agreements in place with them. Their use of data is governed by our agreements and their respective policies. This processing is essential to provide the core features of the Niju Service.


7. Data Retention and Service Improvement

7.1. Data Retention As a Company, you can delete a Candidate's interview data from your dashboard at any time.

Niju's policy is to automatically and permanently delete all raw, identifiable Candidate Data (video, audio, screen recording, IP address) 30 days after the interview is completed, or sooner if the Company deletes it.

7.2. Service Improvement We reserve the right to use Anonymized Data to improve our services. This includes data derived from interviews (such as anonymized transcripts, code, and AI reviews) that has been fully anonymized and aggregated, and cannot be used to identify any individual Candidate or Company.


8. Acceptable Use

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You will not:

  • Decompile, reverse engineer, or otherwise attempt to access the source code of the Service.
  • Use the Service to record, send, or store any content that is illegal, defamatory, obscene, or infringes on any third-party rights (including copyright or privacy rights).
  • Attempt to bypass any security measures, including the 20-minute time limit.
  • (For Candidates) Impersonate another person or use any AI-persona, deepfake, or similar technology to complete the interview. Our AI may check for this to ensure the authenticity of the session, which is then flagged for human review by the Company.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Coffee Tap Studio SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of, or inability to access or use, the Service; (b) any hiring decision made by a Company based in whole or in part on the Service; (c) any bugs, errors, or inaccuracies in the AI Report or other aspects of the Service; (d) any unauthorized access, use, or alteration of your data.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.


10. Updates to these Terms

We may update these Terms from time to time. The most current version will always be available on our website. If we make a change that we believe is material, we will notify you (for example, by sending an email to the address associated with your account or by posting a notice within the Service). Your continued use of the Service after any changes constitutes your acceptance of the new Terms.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Bucharest, Romania.
